1. Acceptance of Terms

Welcome to Scaneaza Eticheta! These Terms & Conditions ("Terms") govern your use of the Scaneaza Eticheta application and website (collectively, the "Service"), which is owned and operated by NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Service.

2. Service Description

Scaneaza Eticheta is designed to scan the ingredients of a product and provide details about each ingredient using artificial intelligence (AI) technology, specifically OpenAI and Google AI models via Vertex AI. This technology classifies ingredients based on their potential benefits or harms, generates an overall health score for the product, and provides brief explanations for each classification and the score.

3. User Eligibility & Registration

To use the Service, you must register using your Google or Apple account, providing information such as your IP address, email, name, and other data as required. The Service is intended for the general public, and by registering, you confirm that you have the right to provide this information.

4. User Responsibilities & Acceptable Use

Users are expected to use the Service responsibly. Misuse may result in termination of access.

You agree to use the Service only for its intended purposes and not to engage in any activity that is harmful to the Service, its users, or its reputation. Prohibited behaviors include, but are not limited to, hacking, spreading malware, and engaging in fraudulent activities.

Users are solely responsible for any content they share from the Service on social media or other platforms. NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ is not responsible for any defamatory, exaggerated, or out-of-context claims made by users or influencers based on the results provided by the Service.

5. Intellectual Property

All content provided by the Service, including the Application, Website, text, graphics, logos, and software, is owned by NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ and is protected by intellectual property laws. All rights reserved. Unauthorized use of the content is strictly prohibited.

6. User-Generated Content & Scanned Images

When you scan a product using the Service, the images you capture (including but not limited to ingredient lists, nutritional tables, and product front images) may be stored and associated with that product's barcode. These images may be reused and displayed to other users who scan the same barcode, in order to provide faster and more accurate product information. By using the Service, you grant NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ a non-exclusive, worldwide, royalty-free, perpetual license to store, use, display, and distribute these scanned images within the Service. This license persists even after your account has been deleted. Images may also be used for improving the Service, training and enhancing our AI models, research, and analytics.

7. Disclaimer of Warranties

The Service is not a medical device and does not constitute medical advice. It cannot be used to diagnose or treat allergies or any medical conditions. The results provided by the Service are strictly informational and indicative — they do not constitute an official health analysis or confirmation of product quality.

The AI technology used by the Service, including OpenAI and Google AI models via Vertex AI, is not guaranteed to be accurate 100% of the time. Users should exercise caution and discretion when relying on the information provided. NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ will not be held responsible for any inaccuracies or the consequences of using the Service.

8. Limitation of Liability

You expressly understand and agree that NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any other damages whatsoever, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), arising out of, or resulting from:

  • (a) the use or inability to use the service;
  • (b) the use of any materials, user content, or other material on the service or any websites linked to the service;
  • (c) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
  • (d) unauthorized access to or alteration of your transmissions or data;
  • (e) statements or conduct of any third party on the service; or
  • (f) any other matter relating to the service.

In no event shall our total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence), or otherwise) exceed the amount paid by you, if any, for accessing the service, and in no event exceed one hundred euro (€100.00).

If you are dissatisfied with any portion of the service, or with any of these terms, your sole and exclusive remedy is to discontinue using the service. If any portion of this limitation of liability is found to be invalid, liability is limited to the fullest extent permitted by law.

9. Payment & Subscriptions

Payments for any subscription plans or services offered through Scaneaza Eticheta will be processed via Apple Pay or Google Pay. Details regarding subscription plans, refunds, and cancellations will be provided separately.

10. Unlimited Scans & Fair Use Policy

Certain subscription plans include unlimited product scans. This unlimited access is subject to a Fair Use Policy designed to ensure a quality experience for all users.

Unusual usage patterns may result in temporary restrictions. Examples of unusual usage include, but are not limited to:

  • (a) Automated or bot-driven scanning activities;
  • (b) Scanning volumes that significantly exceed normal usage patterns;
  • (c) Using the Service for data harvesting, scraping, or reselling scan results;
  • (d) Sharing account credentials with multiple users.

If unusual activity is detected, NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ reserves the right to temporarily restrict or suspend access to the unlimited scanning feature. Users may be notified of any restrictions and may contact us at hi@scaneaza-eticheta.ro to discuss reinstatement.

11. Content Creator Program

Participation in the Scaneaza Eticheta Content Creator Program ("Program") is subject to the following additional terms:

  • (a) NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ reserves the sole right to accept or reject any application to the Program at its discretion, without obligation to provide reasons for such decision.
  • (b) To maintain eligibility for the Premium benefits under the Program, content creators must produce and publish a minimum of two (2) videos featuring the Scaneaza Eticheta application each calendar month.
  • (c) Content creators must maintain a minimum of 1,000 followers/subscribers on their platform to remain eligible for the Program.
  • (d) All content created must comply with our brand guidelines and must not contain any misleading information about the Service.
  • (e) By participating in the Program and creating content featuring Scaneaza Eticheta, content creators grant NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, and promote such videos and content across all our marketing channels, including but not limited to our website, social media, and advertising materials.
  • (f) NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ reserves the right to terminate a content creator's participation in the Program at any time, with or without cause, including but not limited to failure to meet the monthly content requirements, violation of these Terms, or any conduct that may harm the reputation of the Service.
  • (g) Premium benefits provided under the Program may not be transferable and may have no cash value unless otherwise specified by NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ.
  • (h) The Program terms may be modified at any time at the sole discretion of NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ.

12. Amendments & Termination

These Terms may be updated from time to time. Continued use of the Service after such updates constitutes your agreement to the new Terms. Accounts may be terminated by contacting us at hi@scaneaza-eticheta.ro.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which NICOLAE ELISEI PERSOANĂ FIZICĂ AUTORIZATĂ operates, without regard to its conflict of law provisions.

By using Scaneaza Eticheta App or Website, you acknowledge that you have read, understood, and agree to be bound by these Terms.

14. Manufacturer Reporting

Product manufacturers who believe that a product label displayed in the Service is outdated or incorrect may report it by contacting us at hi@scaneaza-eticheta.ro.
